Two Charged in Homicide Investigation

Date/Time of Incident: February 23, 2013 / 1:20 A.M.

Location of Incident:  3000 McDonald St

Arrested:        Augustus S. Marshall, age 27, Fort Wayne

Charge:           Murder

Arrested:        Jose J. Lopez, age 23, Fort Wayne

Charge:           Murder

Fort Wayne, Ind – Two men have been charged in connection with a fatal shooting that occurred on February 23rd, 2013 in the 3000 block of McDonald Street; Augustus S. Marshall and Jose J. Lopez are currently confined in the Allen County Jail.

Marshall and Lopez were the subjects of a vehicle pursuit later that morning on February 23, 2013.  Officers were responding to a reported disturbance with shots fired at 5133 Coldwater Road, Sunoco Gas Station.  A specialty unit (an officer on OWI patrol) spotted the suspect vehicle from the disturbance and attempted to initiate a traffic stop.  The vehicle continued to flee and a pursuit ensued.  The vehicle pursuit came to an end when the suspect vehicle collided with a parked vehicle in the driveway of a home in the 2000 block of Brown Street.  The driver and passenger of the suspect vehicle both then fled on foot.  Footprints in the snow led officers from the vehicle to the rear of another home in the 2000 block of Brown Street.  At this time, the female resident of that home fled her home screaming to officers that there were people inside.  The two intruders, Marshall and Lopez, were found hiding inside and were taken into custody by officers at that time.

These incidents remain under investigation with the City of Fort Wayne Police Department, the Allen County Prosecuting Attorney's Office, and the Allen County Coroner's Office.
