About six months ago (august 2009) I sold my (co owned with my mother in warsaw) 95 saturn to a girl in columbia city. She paid cash ($100 although she insists it was $200, although this isnt the issue), I gave her a receipt and signed the title over to her. I gave her the key so she could get acquainted with the car and how to start it as its old and a manual transmission.
I still needed to take my plate off the car and went inside to get the screwdriver. She must not have heard me tell her to wait because she left with the car. I called her immediately and told her i needed my plate back. She asked me to give her a couple days so she could drive it to get the title transfered and get plates. I agreed and told her as long as I had the plates within 7 days.
She never returned the plates and she moved so her address was no good. I also did not have a good phone number for her so the car with my plates was lost to me.
after a while i got busy with my life and just put the car issue behind me. In January, an officer went to my mother's home in warsaw and asked her where the car was because the plates were indicated in a hit and run in fort wayne. The officer spoke to me over the phone asking who i had sold the car to. At that point it had been so long i couldn't remember her name. I then checked online with the bmv only to discover the car was still titled to me. I got the renewal paperwork for my plates about a week later.
On February 12, my saturn was back in the parking lot of the apartment complex where i live because the girl was here visiting a neighbor. I called local police and asked them if it were legal for me to take my plates off the car now. They said if the car is still titled to me then i could take the plates and the car.
I did take the plates off and the girl came out and insisted she had plates for the car. but that she couldn't get the car titled because she gave the title to someone else to hold for her and they wont give it back to her. obviously if you cant title the car you couldnt have gotten plates so i knew she was lying. I told asked her bout the hit and run and she gave an elaborate story about a pissed off boyfriend making up a false report to get her car towed.
long story short, I have the car in my possession now, she is trying to sue me to return it to her. during the entire six months she had it, she didn't title the car, didn't insure the car, and apparently left the scene of an accident.
my question is, whether or not I will be implicated in the accident that happened in january or if the city of fort wayne is likely looking for hte car for impound. it does have some damage to it that wasn't present when i sold it to her. it was a warsaw officer that spoke to us back in january (i think it was january 8th or there abouts). i contacted him but he didn't have a case number or anything. who do i need to talk to?
